Easement

An easement is a non-possessory right to use another party's real property for a specific purpose — common examples include utility easements, access easements, and conservation easements.

What it means

Easements burden the servient property and benefit the dominant property (or an identified party). Common CRE easements include utility easements (power, water, telecom), ingress/egress easements (access to public right-of-way), reciprocal easements (shared parking in retail centers), and conservation easements (development restrictions for conservation purposes).

Easements run with the land unless terminated. Buyers should review title commitments for easements affecting the property — some easements meaningfully reduce developable area or add ongoing maintenance obligations.
